Refund Policy
Important: This policy is part of the Terms of Service and explains when refunds are required, when they are not available, how the refund workflow operates, and your rights as a purchaser of paid posting services on NamasteJAX.com.
1. Scope of This Policy
This Refund Policy applies exclusively to paid posting purchases made through NamasteJAX.com. Free postings do not involve any payment and are therefore not subject to refund provisions.
All paid postings are one-time purchases. NamasteJAX.com does not offer recurring subscriptions or auto-renewal at this time.
Each paid section placement constitutes a separate, independent purchase. Where the same business or individual appears in more than one paid section, refund eligibility is evaluated on a per-purchase basis.
The paid service period begins on the Admin approval date — not the date of purchase.
All refund requests must be submitted within thirty (30) calendar days of the original transaction date. Requests received after this period will not be considered, except where expressly required by applicable law.
2. When a Full Refund Applies
A full refund is mandatory only in the following circumstance:
Admin is unable to publish an initial paid submission that has never been approved or made Active, and payment was actually collected. In this case, the paid service never officially commenced. This full-refund obligation also applies if the submission was first placed on hold, resubmitted, and ultimately rejected — provided the posting never reached Active status at any point.
3. When No Refund Applies
No refund will be issued in any of the following circumstances:
An approved paid posting has become Active. Once the service period has commenced, no refund is available except where NamasteJAX confirms a billing error.
You voluntarily delete an active paid listing before its term expires. The listing will be removed from public view and no prorated refund will be issued for any unused portion of the paid term.
A paid posting expires at the end of its purchased term. Expired listings are not automatically renewed. You must create a new posting to continue advertising.
A posting did not generate leads, clicks, inquiries, sales, bookings, or other measurable business results. NamasteJAX.com does not guarantee any particular outcome from a paid posting.
You change your mind after purchase, wish to switch sections, want to modify the purchased duration, request content revisions after submission, or are dissatisfied with moderation decisions that are permissible under the Terms of Service and Community Posting Guidelines.
Content is removed, limited, or not published because it violates the Terms of Service, Community Posting Guidelines, applicable law, or platform rules — except where a refund is expressly required by this policy or by law.
4. Billing Errors and Duplicate Charges
If NamasteJAX.com confirms a duplicate charge, pricing error, or other billing mistake attributable to NamasteJAX.com or its payment processor (Stripe), the incorrect amount will be corrected or refunded to the original payment method.
Billing error claims must be reported within thirty (30) calendar days of the transaction date. Claims submitted after this window will not be honored except as required by law.
Promo codes have no cash value and are not redeemable for cash under any circumstances.
5. Chargebacks and Payment Disputes
If you initiate a chargeback or payment dispute with your card issuer or financial institution without first contacting NamasteJAX.com through the process described in Section 7 (Contact), NamasteJAX.com reserves the right to:
Contest the chargeback using all available documentation, including purchase records, submission history, and communication logs.
Immediately suspend or terminate the associated account and all active listings pending resolution of the dispute.
Recover any amounts reversed through a chargeback, together with any fees or penalties imposed on NamasteJAX.com by its payment processor as a result of the dispute.
NamasteJAX.com strongly encourages you to resolve any payment concerns directly before initiating a chargeback. Legitimate billing errors are addressed promptly under Section 4.
6. How the Refund Process Works
When a paid initial submission is not published after payment has been collected, Admin initiates the refund through the Admin Dashboard.
Because NamasteJAX.com does not store full credit card numbers or card security codes, all approved refunds are processed through Stripe to the original payment method only.
A posting is not finally rejected until refund success is confirmed by Stripe. If the refund attempt fails or confirmation is delayed, the posting remains in its pre-rejection review state until the refund succeeds.
Please allow up to ten (10) business days for refunds to appear on your statement, depending on your card issuer or bank.
7. Discretionary Refund Requests
Except for the mandatory full-refund workflow described in Section 2, confirmed billing errors under Section 4, or any refund expressly required by applicable law, refunds are not guaranteed.
NamasteJAX.com may, at its sole discretion, review other refund requests on a case-by-case basis. Any courtesy refund remains entirely discretionary and may be denied for any lawful reason. Approval of a discretionary refund in one instance does not create an obligation or precedent to approve similar requests in the future.
8. Limitation of Liability
To the maximum extent permitted by applicable law, NamasteJAX.com's total liability arising out of or related to any paid posting purchase shall not exceed the amount actually paid by you for the specific posting in question. NamasteJAX.com is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform, the performance of any paid posting, or any refund decision.
9. Governing Law
This Refund Policy is governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising under this policy shall be subject to the exclusive jurisdiction of the state and federal courts located in St. Johns County, Florida.
10. Changes to This Policy
NamasteJAX.com reserves the right to modify or update this Refund Policy at any time. Your continued use of the platform after any such changes constitutes your acceptance of the updated policy. It is your responsibility to review this policy periodically.
Changes to this policy do not apply retroactively to purchases made before the updated effective date.
